Welcome to PixShot AI! These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and AI-powered services (collectively, the "Service").

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, then you may not access the Service.

1. Definitions

  • "Service" refers to the PixShot AI website, mobile app, and all related services provided by us.
  • "Content" refers to images, photos, videos, text, or other materials that you upload, generate, or transmit through the Service.
  • "User" refers to any individual who accesses or uses the Service.

2. Account & Eligibility

2.1 Age Requirement

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. User Content & License

3.1 Ownership

You retain all rights and ownership of the original content you upload to PixShot AI. We do not claim ownership of your source images or the AI-generated results.

3.2 License to PixShot AI

By uploading Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, process, and display such Content solely for the purpose of providing the Service to you (e.g., executing the face swap or image enhancement). This license terminates when your Content is deleted from our systems.

3.3 Your Warranty

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all Content sent by you. You agree not to upload any Content that infringes on the intellectual property or privacy rights of any third party.

4. Prohibited Conduct

You agree not to use the Service to:

  • Generate or upload Non-Consensual Intimate Imagery (NCII), deepfakes of real people without authorization, or child sexual abuse material (CSAM).
  • Violate any applicable national or international laws or regulations.
  • Infringe upon the rights of others, including privacy, publicity, and intellectual property rights.
  • Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service.
  • Use automated means (bots, scrapers) to access the Service without permission.

Zero Tolerance Policy: We strictly prohibit the creation of harmful or illegal content. Accounts found in violation will be permanently banned and reported to relevant authorities if necessary.

5. Virtual Credits & Subscriptions

Certain features of the Service may require the purchase of virtual credits or a subscription.

  • No Monetary Value: Virtual Credits have no real-world monetary value and cannot be exchanged for cash.
  • Non-Refundable: All purchases are final and non-refundable, except as required by applicable law.
  • Expiration: We reserve the right to expire unused credits if an account remains inactive for a period of 12 months.

6. Intellectual Property Rights

The Service and its original content (excluding User Content), features, functionality, and AI models are and will remain the exclusive property of PixShot AI and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. PixShot AI makes no representations or warranties of any kind, express or implied, regarding the operation of the Service, the accuracy of the AI-generated results, or that the Service will meet your requirements.

8. Limitation of Liability

To the maximum extent permitted by law, PixShot AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
